Terms And Conditions For Kangoo Jumps Workshops / Instructor Trainings

These Terms and Conditions govern the participation in any of the Kangoo Jumps Instructor Training programs ("Training") organized by Agnese Bluma ("Organizer"). By registering for the Training, you agree to comply with these terms. These terms and conditions are the standard terms which apply:

  1. to provision of Instructor trainings, incorporating Kangoo Jumps® Fitness Programs by any of Kangoo Club Southend invited/hired International KJ Trainers operating in the whole United Kingdom.

  2. where the customer is a “Consumer” as defined by the Consumer Rights Act 2015.

Definitions and Interpretation
In these Terms and Conditions, unless the context otherwise requires, the following expressions have the following meanings:

“Business” - means any business, trade, craft, or profession carried on by You or any other person/organisation;

“Consumer” - means a “consumer” as defined by the Consumer Rights Act 2015, and in relation to these Terms and Conditions means an individual who receives or uses services from Us consisting of one or more training day for the individual’s personal and/or business purpose;

“Data Protection Legislation” - means the Data Protection Act 1998 and the General Data Protection Regulation (GDPR) (Regulation (EU) 2016/679) as amended or replaced from time to time;

“Organizer” - means a person or group of people who plan and arrange the workshop either in-person or remotely via Zoom and/or other online platform or lead any physical fitness activity, including any teaching, instruction or training and all facilities, services, equipment, and other goods and materials which we provide/use in connection with these workshops;

"Workshop / Training" - any and all Kangoo Jumps Fitness Programs, Kangoo Power™, Kangoo Dance™, Kangoo Bootcamp™, Kangoo Discovery™, Kangoo Kick&Punch™, as well as Aerobic /  Exercise to Music course, but not limited to;

“Our premises” - means the premises at which We hold workshops and which may change from time to time;

“Price List” - means Our price list for any workshops We offer. More details of the available workshops and their prices are available from kangooclubsouthend.co.uk/workshops-events

  1. Eligibility
    Participants must be at least 18 years old and in good physical condition to partake in our physical activities. It is recommended that participants consult a medical professional before engaging in the Training.

  2. Registration and Payment
    a) A completed registration form and full payment of the training fee are required to secure a spot in the Training.
    b) Payments are non-refundable unless otherwise stated in these terms. 
    All prices are subject to No VAT.
    c) The Organizer reserves the right to cancel or reschedule the Training. In such cases, participants will be offered a refund or the option to attend a rescheduled session.

  3. Cancellation and Refund Policy
    a) Cancellations made by participants within a cooling-off period of 14 calendar days of registration and payment are eligible for a full refund, minus an administrative fee £19.49.
    b) Cancellations after the cooling-off period of 14 days are non-refundable.
    c) No refunds will be issued for non-attendance.
    d) In the event of unforeseen circumstances (e.g., illness, travel restrictions), the Organizer may offer a transfer to a future Training session at their discretion.

  4. Participant Responsibilities
    a) Participants must follow the instructions provided by the Trainer and comply with all safety regulations.
    b) The Organizer is not responsible for any injuries or health issues arising from participation.
    c) Participants must use the original Kangoo Jumps rebound shoes and related equipment responsibly and in accordance with safety guidelines.                                                            d) 
    Participants must not attend the Training whilst under the influence of alcohol, narcotics, tranquilizers or any medication or other substance which may affect your ability to exercise safely. If it seems like you’re not in the right state to take a part in the Training properly, then we can ask you to leave. No refund is offered.

  5. Certification / Licensing
    a) Completion of the Training does not automatically guarantee certification / licensing. Participants must meet the assessment criteria to be awarded a specific Instructor certification / licensing. Participants who have not successfully completed a KJ Licensing Program will have 90 calendar days to retest live (subject to trainer/mentor availability) or submit a video to the Organizer. There are 3 attempts given for a free re-test, thereafter a fee of £49 per re-test. These fees apply to only the 90-day period following the initial workshop. Any participant who fails to retest within the 90-day window will need to retake the entire program – standard fees apply.
    b) Kangoo Jumps licensing is valid for a specified period of 2 years and requires renewal and continuing education as determined by the Organizer.                                                         c) Kangoo Jumps licenses must be renewed within maximum of 6 months after the expiry date. After that your licensing will be cancelled and you will be required to undergo a full Training / Workshop by paying all the necessary fees again.

  6.  Intellectual Property
    a) Training materials, including manuals, videos, and other resources, are the intellectual property of the Organizer and/or Trainer and are provided for personal use only.
    b) Participants may not reproduce, distribute, or share Training materials without prior written consent.

  7.  Liability Waiver
    a) By participating in the Training, you acknowledge the inherent risks associated with physical activity and agree to release the Organizer, its trainers, and affiliates from any claims, damages, or liabilities arising from your participation.
    b) The Organizer is not responsible for lost or stolen personal belongings.

  8. Code of Conduct
    a) Participants are expected to behave respectfully towards instructors and fellow attendees. Any form of misconduct may result in removal from the Training without a refund.
    b) The Organizer reserves the right to refuse participation to anyone deemed unfit or disruptive to the Training environment.

  9. Privacy and Data Protection
    a) By registering for the Training, you agree to the collection and use of your personal data for training and communication purposes. 

    b) Your personal information will not be shared with third parties without your consent, except as required by law and to fulfil Training / Workshop certification / Licensing.

  10. By registering for the Training, you acknowledge that you have read, understood, and agreed to these Terms and Conditions.

  11. You must be dressed appropriately for rebound exercise - comfortable sports wear, a high support sports bra, thick or double cotton calf length socks. Loosely swinging or sharp jewellery should be removed before the Training. If You do not comply with any of these dress requirements, We may not allow You to participate.

  12. You must familiarise Yourself with and follow any instructions or information which We give You from time to time or on any occasion relating to any fire or other emergency situation or to other issues relating to health or safety.

  13. If you are suffering from symptoms of flu, Covid-19 or other contagious respiratory illnesses and have attended our in-person Training, please make Kangoo Club Southend aware immediately.  You must not attend any in-person Trainings if you have tested positive for Covid-19 or any other variants connected with Covid-19.

  14. We do not permit You to:
  • smoke/vape anywhere on Our premises;

  • chew chewing gum while rebounding;

  • bring to Our premises or the premises of which Our premises are a part, any person prior agreement with Us. If You have a written permission to bring them along, whether participating or not, they will remain Your sole responsibility before, during and after the Training. They are not allowed to walk/run around the building unattended. They must not disturb and distract in any way other participants. â€‹

 15. Furthermore, if you are a “consumer” as defined by the Consumer Rights Act 2015, or a consumer for the purposes of any other consumer protection legislation, nothing in these Terms and Conditions is intended to or will exclude, limit, prejudice, or otherwise affect any of Our duties or obligations to You, or Your rights or remedies, or Our liability to You, under:

  1. the Consumer Rights Act 2015;

  2. the Regulations;

  3. the Consumer Protection Act 1987; or

  4. any other consumer protection legislation

  5. as that legislation is amended from time to time.

  6. For more details of Your legal rights, please refer to Your local Citizens’ Advice Bureau or Trading Standard Office.

 16. Changes to Terms and Conditions

We may from time to time change these Terms and Conditions without giving You notice, but We will use Our reasonable endeavours to inform You as soon as is reasonably possible of any such change.

 17. Regulations
We are required by the Regulations to ensure that certain information is given or made available to You as a Consumer before We make Our contract with You (i.e. before We accept Your registration) except where that information is already apparent from the context of the transaction. We have included the information itself either in these Terms and Conditions for You to see now. All of that information will, as required by the Regulations, be part of the terms of Our contract with You as a Consumer.

 18. Complaints
We always welcome feedback from You and, whilst We always use all reasonable endeavours to ensure that Your experience as Our customer is a positive one, We nevertheless want to hear from You if You have any cause for complaint. If You have any complaint about the Training / Workshop or any other complaint about Us or any of Our staff, please raise the matter with Us directly by email: kangooclubsouthend@gmail.com.

 19. No Waiver
No failure or delay by Us or You in exercising any rights under these Terms and Conditions means that We or You have waived that right, and no waiver by Us or You of a breach of any provision of these Terms and Conditions means that We or You will waive any subsequent breach of the same or any other provision.

 20. Severance
If any provision of these Terms and Conditions is held by any competent authority to be invalid or unenforceable in whole or in part the validity of the other provisions of these Terms and Conditions and the remainder of the provision in question shall not be affected.

 21. Law and Jurisdiction

  1. These Terms and Conditions, the Contract, and the relationship between you and Us (whether contractual or otherwise) shall be governed by, and construed in accordance with the law of England & Wales.

  2. As a consumer, you will benefit from any mandatory provisions of the law in your country of residence. Nothing in Sub-Clause 21.1 above takes away or reduces your rights as a consumer to rely on those provisions.

  3. Any dispute, controversy, proceedings or claim between you and Us relating to these Terms and Conditions, the Contract, or the relationship between you and Us (whether contractual or otherwise) shall be subject to the jurisdiction of the courts of England, Wales, Scotland, or Northern Ireland, as determined by your residency.
